Can Hong Kong residents buy property in Australia?
Yes. Hong Kong residents who are not Australian citizens need Foreign Investment Review Board (FIRB) approval before they buy, and they are limited to new dwellings, off-the-plan apartments and vacant land to build on. Foreign persons have been banned from buying established homes since 1 April 2025. Most states also charge foreign buyers a stamp duty surcharge, which is 9% in New South Wales.
I'm an Australian citizen living in Hong Kong. Do I need FIRB approval?
No. Australian citizens are exempt from FIRB wherever they live, and can buy new or established property. The practical hurdles for Australians in Hong Kong are lending and tax, not eligibility.
I hold Australian PR but live in Hong Kong. Which rules apply to me?
It depends on how much time you have spent in Australia recently. A permanent resident who is not ordinarily resident in Australia can be treated as a foreign person under FIRB rules, so check your position before you sign a contract. We cover this in the first SPARK session.
Will Australian banks accept my HKD salary?
Yes, HKD is one of the foreign currencies most expat lenders accept. Banks usually count only part of your foreign income, often 60% to 80% of it, and expect a bigger deposit from non-residents. We introduce you to brokers who write expat loans every week, not once a year.
How is Australian rental income taxed if I live in Hong Kong?
Non-residents for Australian tax purposes pay tax from the first dollar of rental income, with no tax-free threshold, and lose the main residence capital gains exemption. Hong Kong taxes on a territorial basis, so Australian rental income and gains are generally taxed in Australia only. Get personal tax advice for your situation.
Is there a tax treaty between Australia and Hong Kong?
Australia and Hong Kong do not have a comprehensive double tax agreement. For most Hong Kong-based owners this matters less than you might think, because Hong Kong does not tax foreign rental income or capital gains. The Australian side is where the planning happens.
Does Property NXT sell Hong Kong property?
No. Property NXT deals exclusively in property situated outside Hong Kong and is not licensed to deal with any property situated in Hong Kong. We work only on Australian new-build property, for Australians abroad and overseas investors.
